Based on Article 7 of Law No. 119/2014 “On the Right to Information” (hereinafter “LDI”). The Public Authority (hereinafter “PA”) must publish the Transparency Program (hereinafter “TP”) approved by the Commissioner for the Right to Information and Personal Data Protection (hereinafter “Commissioner”). The PA must publish information according to its functional activity and review and update the TP in any case of change in institutional activity, legal regulatory framework or any other element related to proactive transparency.

The PT specifies the categories of information that must be made public. Public information without a request must be: complete, accurate, up-to-date, easy to consult, understandable, easily accessible and compatible with the original documents in the possession of the AP. Also, before publishing the information, the AP must assess whether there are any legal restrictions on publication.
Acts containing rules, norms or restrictions on the fundamental rights and freedoms of the individual, as well as those with direct effect on them, are made public by displaying or posting on the official website, within 48 hours of the act's approval by the PA.

The transparency program specifies the categories of information that must be made public, the manner of publication, and the legal provisions from which the obligation to publish arises. When publishing information, PAs must take into account the public interest and facilitate easy access to public information.
